Terms of service

Welcome to LoanChefs. By accessing and using our website, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, please do not use the Platform. 

1. Introduction 

1.1 LoanChefs is an online platform that connects users ("Clients") with professional chefs ("Chefs") for booking culinary services, including private chef experiences, catering, cooking lessons, and other related services ("Services"). 

1.2 These Terms apply to all visitors, users, and others who access or use the Platform. 

2. Eligibility 

2.1 You must be at least 18 years old to use this Platform. By accessing or using the Platform, you confirm that you are of legal age to form a binding contract. 

2.2 If you are using the Platform on behalf of a company, organization, or other legal entity, you warrant that you have the authority to bind that entity to these Terms. 

3. Account Registration 

3.1 To access certain features of the Platform, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update it as necessary. 

3.2 You are responsible for maintaining the confidentiality of your account and password and agree to notify us immediately of any unauthorized use or breach of security. 

4. Services 

4.1 Chef Services: Chefs listed on the Platform provide Services directly to Clients. The Services may include private chef meals, catering, cooking classes, and other culinary services. 

4.2 Booking: Clients can book a Chef's services through the Platform. A booking is confirmed once both the Client and Chef agree to the terms of the Service, including date, time, location, and payment. 

4.3 Pricing: Prices for Chef Services are set by the individual Chefs and may vary based on factors such as location, service type, and duration. All prices are listed in the Platform’s currency and are subject to change. 

5. Payment 

5.1 Payment Processing: Payments for Chef Services are processed through a third-party payment processor. By booking a Chef, you authorize the Platform to charge your payment method for the agreed-upon Service price. 

5.2 Fees: The Platform may charge a service fee for processing bookings, which will be clearly disclosed before you confirm your booking. 

5.3 Refunds and Cancellations: Refunds and cancellations are subject to the Chef’s cancellation policy. Clients and Chefs agree to the terms outlined in the booking confirmation. 

6. User Responsibilities 

6.1 Compliance with Laws: You agree to comply with all applicable laws and regulations while using the Platform. 

6.2 Prohibited Activities: You may not: 

  • Violate any applicable law or regulation. 

  • Engage in fraudulent or deceptive practices. 

  • Use the Platform to harass, abuse, or harm other users. 

  • Attempt to interfere with or disrupt the Platform's functionality. 

6.3 Content: You grant the Platform a license to use any content you upload, such as reviews, photos, and feedback, for promotional purposes. 

7. Chef Responsibilities 

7.1 Quality of Service: Chefs are responsible for providing high-quality culinary services that meet the standards advertised on the Platform. 

7.2 Compliance with Health and Safety Standards: Chefs must comply with all relevant health, safety, and sanitation laws and regulations while providing their services. 

7.3 Cancellation and Refunds: Chefs must adhere to the cancellation and refund policies outlined in the booking agreement. 

8. Intellectual Property 

8.1 The Platform’s content, including logos, text, images, and software, is owned by LoanChefs or its licensors and is protected by intellectual property laws. 

8.2 You may not use, reproduce, or distribute any content from the Platform without prior written permission from us, except as necessary for the normal use of the Platform. 

9. Disputes Between Users 

9.1 The Platform is not a party to any disputes between Clients and Chefs. In the event of a disagreement, both parties are encouraged to resolve the issue amicably. If necessary, the Platform may assist in mediating the situation but is not liable for any outcomes. 

9.2 If a dispute cannot be resolved through mediation, both parties agree to resolve the matter through binding arbitration in accordance with the applicable laws of the Netherlands. 

10. Limitation of Liability 

10.1 The Platform provides the Services “as is” and does not guarantee the quality, availability, or suitability of any Chef's services. The Platform is not responsible for any loss, damage, or injury that may occur as a result of using the services. 

10.2 In no event shall LoanChefs be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with these Terms or the use of the Platform. 

11. Indemnification 

You agree to indemnify and hold harmless LoanChefs, its affiliates, employees, agents, and licensors from any claims, losses, liabilities, and expenses (including legal fees) arising out of or in connection with your use of the Platform or violation of these Terms. 

12. Privacy 

Your use of the Platform is also governed by our Privacy Policy, which can be found [here]. 

13. Termination 

13.1 We reserve the right to suspend or terminate your account at our sole discretion, including if you violate these Terms or engage in activities that harm the Platform or other users. 

13.2 Upon termination, you must cease all use of the Platform and, if applicable, pay any outstanding amounts for Services rendered. 

14. Modifications to Terms 

14.1 We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on the Platform or by other means. Your continued use of the Platform after such changes constitutes your acceptance of the updated Terms. 

15. Governing Law 

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Zaandam, Netherlands.
